The most important factor when hiring an international worker is for the Canadian business and the worker to determine whether a Labour Market Impact Assessment is needed.
A positive Labour Market Impact Assessment (LMIA) will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter.
If the employer needs an LMIA, they must apply for one to Employment and Social Development Canada (ESDC).
Once an employer gets the LMIA from ESDC, the worker can apply for a work permit with Immigration, Refugees, Citizenship Canada (IRCC).
To apply for a work permit, a worker needs:
a job offer letter,
a contract,
a copy of the LMIA, and
the LMIA number
NOT every job requires an LMIA. Canada has free trade and mobility agreements with certain countries where an LMIA exemption is granted. An example of such is the International Mobility Program for Francophones.
