This service is for you if you are already in Canada and want to make a refugee claim. Or if you started a claim at the border or airport. It is divided in two phases so you don’t have to pay for the hearing service until you have a hearing date.
Phase 1: Refugee Claim inside Canada
Phase 2: Refugee Hearing
Government fees: currently the government does not charge you any fees for a refugee claim.
This service is for you if you already made a claim in Canada (airport, local office, or border) and already submitted your Basis of Claim form to the Refugee Protection Division and want us to represent you at your hearing.
Service: Refugee Hearing only
This service is for you if your claim was refused and you have the right to make an appeal to the Refugee Appeal Division. You believe that the Member made errors in the decision.
If you made your claim at the border between Canada and the US, you cannot appeal to the Division. You must appeal to the Federal Court.
You are required to notify the Division of your intention to appeal within 15 days after the decision. You or your representative must provide the memorandum of arguments within 40 days of the decision.
